  1. Article 101: Improper Use of Countersign Under the UCMJ

Article 101 applies only in time of war. It covers two acts: disclosing the parole or countersign to someone not entitled to receive it, and giving an entitled person a different parole or countersign from the one the accused was authorized and required to give. Motive, negligence, and an honest mistake about the recipient are not defenses to disclosure. The maximum is death or such other punishment as a court-martial may direct.

  2. Article 100: Subordinate Compelling Surrender Under the UCMJ

Article 100 punishes three things: forcing a commander to give up or abandon a place, vessel, aircraft, other military property, or body of troops to the enemy; attempting to force that; and striking the colors or flag to an enemy without proper authority. The completed compelling offense requires that the position actually be given up or abandoned. Every form carries a maximum of death or such other punishment as a court-martial may direct, at any time, not only in war.
